What is Damage?

Damage is the damaged effect. The term comes from the Latin damnum and is linked to the verb that refers to causing harm, impairment, discomfort or pain. For example: “Your words have hurt me”, “The bullet caused irreparable damage to the nerves of the left leg”, “The material damage was immense after the fire, but no fatalities or injuries had to be mourned”“The car suffered great damage from the accident.

In some countries of the Americas, the notion of harm is used to name curses or evil eye (the supposed ability of certain people to cause evil in others by simply looking at them): “A witch told me that someone has hurt me”.

In addition to all the above, we cannot forget that in certain countries of the Americas, as would be the case in Nicaragua or Guatemala, a verbal term is used that incorporates the aforementioned term of injury. Specifically, we are referring to the phrase “hurt a maiden” which means to devirge a young woman.

In the field of trade there is also an expression that makes use of the term that we are now analyzing. We are referring to “profits and damages” that it comes to exercise primarily as synonymous with what would be “profits and losses”, that is, the document where both the profits that a company itself is having and the aforementioned losses are noted.

For the right, damage is a harm to a person or his estate because of another subject. The damage, therefore, is detrimental to the rights, property or interests of one individual as a result of the action or omission of another.

In addition, in the case of Spain, a clear differentiation is established within what the types of damages can be. In this way, they are divided into two groups: moral damage and property damage. The former can say that they are those who have such scope and severity that they cannot be repaired even with the payment of an economic amount whatever it is. A clear example of moral harm would be the loss of a loved one.

The latter, the assets, are those that can be repaired by money or goods that can be replaced by this.

Damage can be generated by will, guilt or fortuitousness. Intentional damage occurs when the subject acts intentionally (someone hits another person’s car with a stick and breaks their glass, for example). The culpable damage, on the other hand, occurs by negligence (a person throws a cigarette in the field and generates a fire).

Any damage stirs up an obligation to redress your manager. In certain cases, the damage may also involve a criminal penalty, when the wrongdoing committed is punishable by law.

Within the field of law, it is very common for the expression damages to be used. With it what is done is to make clear the existence of financial compensation that is granted to that person who has suffered damage. It is therefore a way to repair and compensate for that.
